Holding of JCM Meeting with the representative of recognised Association-reg

Sir,
          Subject :- Holding of JCM Meeting with the representative of recognised Association-reg
       
              Kindly refer to Administrative Officer, C & C Excise, Hqrs., Indore's  letter C. No. II(22)07/2011/JCM/Admn/43901 dated 15.01.2013 on the subject cited above. The desired vide referred letter the following are  points are submitted for consideration :-

1.     Re-organisation of Ranges 
In the JCM held in Sept'2009,  the Association submitted that there is a large imbalance of work load in different Ranges of Indore Commissionerate, hence a request was made to Re-organise Ranges' jurisdiction. Later in subsequent JCM held on 23.12.2009  it was informed that a Committee had been formed in the Chairmanship of the then Additional Commissioner- Shri Irfan Ahmed. It was also reported that work of Reorganisation of all Ranges of Indore Commissionerate shall be completed by March'2010. ( Source:- Minutes of JCM held on 23.12.2009)

2.   Sports/ Gym facilities 

In order to have more physical & mental strength, the Association in the JCM held on 23.12.2009 requested to have a sports club/ Gym facilities in Hqrs., Office. To which, it was informed that the then Superintendent( Hqrs.,)- Shri Rajesh Tandon has been asked to prepare a proposal/ report in the matter. As there was progress in the matter, the issue was further raised in the JCMs held on 14.09.2011, 04.01.2012, 24.04.2012 & even in last JCM held on 31.10.2012.


3.  Audit of Central Excise & Customs Staff Welfare Fund

The Association in almost all the JCMs held since Dec'2009 has been raising the issue of Auditing of Central Excise & Customs Staff Welfare Fund.  During JCM held on 24.04.2012, it was informed that Shri Vijay Rathi, C A, has agreed for Auditing of accounts of the Fund on honorary basis. Till date neither the Auditing process has been initiated nor has any FIR been lodged in the matter.

       4. Non-maintenance of Staff quarters at MOG Lines.
        
The Association in almost all the JCMs held since Dec'2009 has been raising the issue of non-maintenance of Staff quarters at MOG lines. It was also brought to notice that the Department is transferring the License-fee to CPWD in-spite of no maintenance is being done by them.

  In respect of points S. No.1 to 4 above, a repeated reply has been communicated to the Association. It’s a sorry state of affair that even after a period of more than 3 years the issues raised above have not been resolved.  The Association has been repeatedly raising these issues with a hope that sooner or later Administration shall have a serious note of it. Association is still hopeful that this grievances redressal mechanism shall emerge as fruitful tool than a mere paper formalities.

5. In order have a close monitoring on the points raised in JCMs, the Association in JCM held on 04.01.2012, requested to communicate monthly progress report on the points sponsored by the Association. Despite being agreed, the same is not being complied.

 6. Minutes of the meeting held on 21st December,2012 by the DGHRD with the representatives of recognised Associations/ federations under the CBEC

Minutes of above referred Meeting ( available on DGHRD's website) may kindly be perused. The following submissions are made on above minutes:-
(i) In compliance to DGHRD's view on point no. B- Scheme of grant of ex-gratia assistance in case of death- a PRO/ Welfare officer may be appointed at the earliest.

(ii) A mechanism may be devised for transparent booking of guest houses on first cum basis.

(iii) An Advisory Committee on Welfare may be constituted & its periodical meeting can hold along with JCM.

7. Medical Claim/ CGHS/ approved Hospital  facility
       In case of clinical emergency whenever an Officer is rushed to a Hospital, requirement of immediate Cash deposit is made by these approved Hospital. A mechanism of giving NOC by Welfare Officer for sanction/ payment of eligible claim can be given to Hospital. Also, a request recommending approval of Bombay Hospital & Choithram Hospital may kindly be forwarded to Co-ordination Committee of Central Govt. Employee, Indore.


8. Deviation from Transfer Policy norms
In recent past Estt. Orders have been issued in violation of transfer policy norms in as much as not only repeated posting of officer(s) to Customs are made, but officer (s) is allowed to continue to Customs posting even after completion of their/ his tenure of One year.

9. Supply of History of Postings

History of Postings of Inspectors of Indore Commissionerate has not been supplied till date, despite assurance given in the in last JCM held on 31.10.2012. It is once again requested to supply the same.

       10. ACES System/ Internet facility

In last JCM problem of  ACES system not working smoothly was raised by the Superintendent Association, highlighting it to be more acute in remote, Ranges in Ratlam Division are also facing the same. Further, Internet facility may kindly be provided also.

11. Non-payment of Salary & Children Education Allowance

In Pithampur Division, payment of Salary to one of the newly Inspector, who joined in the month of Nov'2012, has not made till date. Concerned Divisional Representative of the Association has also raised the issue before the Divisional Assistant Commissioner. Similarly, even after a period of almost a year payment of Children Education Allowance is not made in Pithampur Division. Problem of non-payment of Pay & Allowances are time & again occurring in Pithampur Division. Signals coming to Association are alarming in nature.   

12. Non-payment of Deputation Allowance to Officers returned from SEZ Deputation

Officers repatriated from SEZ, Indore after completion of Deputation are not being paid Deputation Allowance but are asked to contact Assistant Development Commissioner, SEZ, Indore. While the Assistant Development Commissioner vide his letter dated 29.11.2012 has viewed that if they can reimburse the Arrears of VI Pay Commission for the period spent in parent Commissionerate, there should not be any objection on payment of Deputation Allowances by the Parent Commissionerate. It is requested to resolve the stalemate situation. And, efforts may kindly be made at early payment of Deputation Allowances.
