Subject. : Non-adherence  to Transfer policy norms- C reg

Sir,

This is in continuation to Association's earlier letter of even no. dated 26.11.2012 submitted with reference to your office Estt. Orders No. 43/2012 dated 25.10.2012 & No.52/2012 dated 21.11.2012. Meeting of Executive Body  of the Association was held on 19.01.2013. All the transfer orders issued after Annual General Transfer Order including the two referred above were analyzed  in the light of the transfer policy. It  has been decided to once again lodge a protest against the issuance of the Estt. Order No. 52/2012 dated 21.11.2012.

02.    Before this Association once again registers its protest against the said Estt. Order dated 21.11.2012, a review of the background on this issue is inevitable. In brief, prior to issuance of A G T for the year 2011-12, Office Bearers of Superintendents & Inspectors' Association were called by the then Commissioner, Central Excise & Customs, Indore. Apart from other submissions, the Association submitted that no officer shall be repeated to Customs posting unless every other officer had exposure to Customs work. The then Hon'ble Commissioner of Central Excise not only welcomed this submission of the Association but further suggested to limit tenure of ICDs & Air Cargo postings to maximum of One year. Both the Associations of Superintendents & Inspectors endorsed it. Since then the said policy has been followed, until the issuance of above Estt. Order dated 21.11.2012. 

03. Therefore & in view of above, this Association registered its protest against the said Estt. Order No.52/2012 dated 21.112012 before yourgoodself, both in writing & in person. During in person meeting on the issue, your Honor not only assured Office Bearers of the Association to look in to the matter but also assured that there will not be any deviation from the policy, and if had occurred, corrective measures shall be taken.

04.    Despite this Association's protest against unjustified transfer order, neither the said Estt. Order has been modified till date but even in case(s) where officer(s) has completed tenure of one year to Customs posting has not been rotated till date.

05.   In view of above, your kind intervention in the matter is requested to ensure that the  well established norms of transfer policy are being followed.

06.    We trust that the matter will certainly receive your immediate and considerate attention.
